Navy Sergeant arrested: what is known about murder at party in Rio

The death of businessman Davidson Vasconcellos de Matteo Silva, aged 37, during a 15th birthday party in Campinho, in the north of Rio de Janeiro, began to be investigated not only as a case of homicide in a family environment, but as a sequence of events that, according to the first reports gathered in the process, would have evolved in a few minutes from an argument to a fatal outcome.

The main line presented so far indicates that Davidson would not be the initial target of the confusion. According to documents attached to the case and arguments presented by the defense of Navy sergeant Tayana Rangel Cardeal, arrested in the act after the episode, the case began during a disagreement between her and her husband, a military police officer, motivated by jealousy.

The defense maintains that the events occurred in an environment of "generalized confusion" and states that witnesses reported that the shooting took place at a time when people nearby were trying to remove the weapon from the hand of the person being investigated. Among them would be the victim himself.

One of the versions cited in the records attributes to a witness the report that Davidson and another guest were trying to disarm Tayana when the shot was fired. The thesis will also be compared with testimonies, expertise and other elements of the investigation.

The episode also gained repercussion due to the circumstances in which it occurred. According to reports already released about the case, Davidson's wife and daughters were at the party and witnessed the scene.

The defense argues that Tayana is an active military member, has a fixed residence, a lawful occupation and that the case would represent an "isolated and tragic episode", with no elements that indicate a risk to public order or interference in the production of evidence. The request also mentions that the weapon and other evidence would already be seized and under the control of the authorities.

The lawyers also stated that the investigated woman showed signs of emotional changes and drunkenness at the time of the events, a version that is part of the defensive strategy and has not yet been recognized in court.

Report indicates bodily injuries to the person being investigated
Among the documents attached to the process is a physical integrity examination report carried out at the IML (Medical-Legal Institute).

According to the document, Tayana reported having suffered physical attacks after the incident. The examination describes abrasions and bruises in different regions of the body and concludes that there are injuries with a possible temporal connection with the event narrated to the expert. The report, however, does not attribute responsibility for the injuries or analyze their possible relationship with the dynamics of the shooting.

The case is being processed at the Custody Hearing Center of the Capital District under a notice of arrest in the act. Initially, the procedure was registered for simple homicide, but subsequent documents gathered by the defense mention a framework related to article 121, §2, item II, of the Penal Code, of qualified homicide for futile reasons, a hypothesis whose definition will depend on the progress of the investigation and a possible complaint by the Public Prosecutor's Office.

The case remains under investigation by the competent authorities and there is still no judicial conviction. The defense of the person being investigated may speak out throughout the process
