If the PEC that abolishes the 6×1 scale is approved by the National Congress, workers will have two days off per week. The measure, however, does not change the labor rights already guaranteed by the CLT. The debate focuses exclusively on the working day and how it will be distributed throughout the week.


"Everything that concerns payments, vacations, these rights acquired by the CLT, they will be maintained", explained Economy analyst Débora Oliveira, on Live CNN this Tuesday (26).


Rights such as the 13th salary, the minimum wage established by law with annual update, weekly paid rest, vacations with an additional one-third, proportional notice, additional payments for dangerous and unhealthy activities, nighttime additional, FGTS payment and overtime additional will continue to be guaranteed.

"All of this remains preserved. Just because you work fewer hours does not mean you will no longer be entitled to your thirteenth salary", highlighted Débora Oliveira. One of the prerequisites of the proposal is precisely that the reduction in working hours occurs without reducing salaries already in force.


Collective agreements
The main point of attention identified by Débora is the economic impact of reducing working hours on certain sectors. "We have an economy that is very heterogeneous, we have sectors that need different functioning" observes the analyst.


Another point of attention raised concerns the categories that already have rights guaranteed by collective agreement. Bank employees, for example, work 30 hours a week, well below the 44 hours stipulated in the CLT, under a union agreement.

Débora also cites the health sector as an example, which already operates under different scales by collective agreement, both in the private and public spheres, and an eventual approval of the PEC would require adaptations that could increase costs for city halls and other entities.


If the PEC is approved, these conventions will need to be renewed within two months to avoid losing validity. "We will have to rely on the agility of sector unions to guarantee these conventions", explained Débora.


She noted that this detail about collective agreements could represent a strategic nod from the Lula government to unions in an election year.
