On Monday (25), the rapporteur of the PEC (Proposed Amendment to the Constitution), deputy Leo Prates (Republicans) included a substitute for the text that removes the obligation for employees who earn above R$ 21.1 thousand per month to follow the rules of the new working hours.


In the text, the deputy argued that the diversity of realities within the labor market need to be considered and evaluated by the legal system.


Therefore, highly qualified employees require less supervision from employers and have the capacity to negotiate and enact autonomy in defining the conditions under which they carry out their activities, said Prates.

In addition, the deputy also considered that the current working day regime makes the routine less flexible for professionals who have higher education, making them more easily opt for hiring in the form of pj (legal entities).


In the text, the deputy argued that by trying to escape control over their working hours, employees end up being deprived of relevant rights such as paid holidays, 13th salary, FGTS (Service Time Guarantee Fund) and other social protection mechanisms.


Thus, the replacement proposes that employees who receive this type of monthly remuneration are excluded from the working hours limit rules, as well as day-to-day time control.

Changes in the Brazilian working day
During Monday, the president of the Chamber of Deputies, Hugo Motta, stated that the proposal to end the 6×1 scale will determine a working day limit of 40 hours a week after the one-year transition period.


So far, the proposal is for the reduction to be made from 44 hours to 42 hours per week for the worker, which will be included after 60 days of the promulgation of the new rule.


The period will begin after the new amendment to the Constitution is made official, when it is approved by the Chamber of Deputies and the Federal Senate.


In addition, rapporteur Leo Prates also included in his proposal the obligation of two weekly days off for workers, one of them being "preferably on Sundays". Despite the rule, the worker may still choose to take days off that are not necessarily taken on consecutive days.
