6×1: Proposal does not require a sequence of days off and gives preference to Sundays

Among the rights proposed to workers in the text of the PEC (Proposed Amendment to the Constitution) by Leo Prates (Republicanos-BA) regarding the end of the 6×1 scale, presented on Monday (25), is the guarantee of two days off a week, one of them being "preferably on Sundays".

In practice, the model adopts the 5×2 format, which guarantees two days of paid weekly rest. However, the measure does not make it mandatory to have two days of rest throughout the same week, making it possible to choose separate days.

The opinion also provides that conventions and collective agreements may adjust scales and compensatory regimes, as long as the working hours limit and the right to rest are respected.

The measure must be applied in transition phases. After 60 days of the promulgation of the new constitutional amendment, the working hours limit drops to 42 hours per week with paid rest of two days per week. Twelve months after this stage, the limit will be definitively set at 40 hours per week.

The PEC still needs to be approved by both Houses and made official by President Luiz Inácio Lula da Silva (PT). The text is being analyzed by a special committee of the Chamber of Deputies. The expectation is that the board will vote on the proposal next Wednesday (27). If approved, the text will go to the Chamber Plenary.
