From this Tuesday (26th), workers will be able to demand a work environment that also protects mental health, with the update of NR-1 (Regulatory Standard nº 1).


According to experts, the new rules bring Brazilian legislation closer to international standards and reinforce that mental health is also worker health.


NR-1 is the basic guideline for Safety and Health at Work in Brazil. It requires companies to adopt Occupational Risk Management through the Risk Management Program.

The update to Regulatory Standard No. 1 now requires companies to identify and manage psychosocial risks in the workplace. The change occurs amid the increase in sick leave due to mental disorders in Brazil, which cost the INSS (National Social Security Institute) almost R$1 billion in 2025.


Just last year, Brazil reached a historic record of more than 546,000 absences from work due to mental disorders - an increase of 15.6% compared to 2024, according to Social Security.


According to lawyer specializing in labor law, Angela Glomb, some factors need to be formally identified, evaluated and prevented by companies.

She cites examples such as: moral harassment, abusive goals, excessive working hours, constant psychological pressure, toxic organizational climate, work overload, lack of breaks and rest.


"From a legal point of view, the change expands the employer's duty to guarantee a healthy working environment. This strengthens the company's civil liability in cases of mental illness, the obligation to adopt preventive measures, inspection by work auditors and the production of evidence in legal actions", explains Angela.


Another legal aspect to be taken into consideration is the increase in labor actions related to mental health in Brazil. For the lawyer, the tendency is for actions related to mental health to increase as the express inclusion of psychosocial risks in NR-1 creates more objective technical parameters.


In addition, the standardization expands companies' duty to prevent, facilitates the characterization of employer negligence and strengthens the production of evidence in legal proceedings.


"Issues that were previously treated subjectively now have clear normative support. The growth of processes involving burnout, occupational anxiety, work-related depression, organizational bullying and abusive goals is likely.

Companies that do not implement effective prevention policies could face heavy compensation sentences", he highlights.

From a practical and preventive medicine point of view, the experts' assessment is that this requirement can protect the worker's health before becoming ill.


For Amanda Bittencourt, manager of healthcare provider Care Plus Ocupacional, the update represents a strategic change, in which factors such as the corporate environment, emotional pressure, leadership relationships and work organization gain formal weight.


"This is crucial because the first signs of illness appear more silently, long before the actual absence, resulting in symptoms such as constant exhaustion, difficulty concentrating, changes in sleep and increased stress in teams", he points out.


"From the moment the standard requires a structured look at psychosocial risks, companies will be better able to identify patterns before burnout, acting preventively to treat the root of the problem, and not just its symptoms."


Worker safety when making reports must also be taken into consideration, since the objective of the standard is not to expose the employee individually, but to allow a broader and preventive reading of risk factors within organizations.


The manager explains that this information is returned to the company anonymously in relation to the employee's name and population data analysis.


In other words, company managers look at statistical panels for a sector, without accessing individual diagnoses.


"And in this way, they can improve the environment, respecting confidentiality criteria and guaranteeing the safe reception of teams", he concludes.
