The CNJ (National Council of Justice) analyzes this Tuesday (26) a proposed resolution that creates a single and standardized paycheck model for magistrates across the country, in a new offensive by the Judiciary to expand control over the so-called "hangings" and increase the transparency of remunerations.


The measure was presented by the president of the CNJ and the STF (Supreme Federal Court), minister Edson Fachin, and will be discussed by the council plenary. The text establishes the creation of the so-called TRU (Unified Remuneration Table) and determines the mandatory adoption of a standardized nomenclature for all funds paid to judges.


Under the proposal, each judge will receive only a single monthly paycheck, comprising all remuneration and compensation installments. The text also prohibits the issuance of supplementary, parallel or complementary sheets for payments made separately.

According to the CNJ, an audit carried out in courts identified more than 500 different nomenclatures used to classify compensation payments, which, in the body's assessment, makes it difficult to monitor and compare remuneration data between courts.


The proposal comes in the wake of the STF's recent decisions on super salaries and the constitutional ceiling. In March of this year, the Court consolidated its understanding that authorized the payment of certain compensation amounts and additional benefits to judges, as long as the limit of up to 35% of the subsidy was respected.


The draft presented by Fachin incorporates this understanding and provides that the paycheck must separately itemize installments such as daily allowances, subsistence allowances, bonuses for accruing jurisdiction, vacation compensation and retroactive amounts pending payment.

The text also prohibits the creation of new headings or the use of nomenclatures other than those provided for by the CNJ for payments not authorized by federal law or joint regulation by the CNJ and the CNMP (National Council of the Public Ministry).


Another point considered strategic by the Judiciary leadership is the strengthening of inspection mechanisms. The proposal provides for standardized sending of payrolls to the CNJ, integration of court systems and access by the National Justice Inspectorate to the courts' databases.


If approved, the resolution will give courts 60 days to adapt their systems to the new rules.
