The trial in the case of the death of Henry Borel, a child who died at the age of four in March 2021, in Rio de Janeiro, will resume this Tuesday (26).

The jury session was interrupted on Monday afternoon (25), around 5 pm, and will be resumed with new testimonies from witnesses linked to the investigation of the case.


According to the schedule scheduled for this Tuesday, they should be heard:


- Delegate Henrique Damasceno;
- Delegate Ana Carolina Medeiros;
- And criminal expert Luiz Carlos Prestes.

According to the IML report, the child suffered 23 injuries and died from internal bleeding caused by blunt action, discarding the initial version of a domestic accident presented by the defendants.


What the first day was like
During the trial, Dr. Jairinho even argued with prosecutor Fábio Vieira. At the session, the prosecutor stated that Jairinho's defense was using a "technique" to tire and confuse the jury. According to him, the action had already been commented on by the lawyer on social media.


The statement, made during the request for nullification of evidence in the case, provoked an immediate reaction from the lawyer, who interrupted the prosecutor's speech and asked for "order during the session".

At the beginning of the session, Jairinho claimed that it would be "impossible" to be tried due to the health of his main lawyer, Fabiano Lopes, who recently suffered a heart attack.


The defendant stated that he did not have enough time to align strategies with the other members of the panel and asked for the jury to be postponed. In response, the prosecutor in the case classified the attitude as an attempt to "not want to face reality" and highlighted that the defense has been following the case for years.

Faced with the possibility of suspension, the MP asked that Jairinho be removed from Bangu 8, a unit intended for prisoners with higher education and a media profile, and sent to Bangu 1, a place of isolation for criminal leaders and highly dangerous inmates.


However, upon learning of the MP's position, the former councilor reversed his decision to dismiss his defense team.


Accusations and context of the crime
Jairinho and his ex-wife, Monique Medeiros, are on trial for the death of Henry Borel, aged 4, which occurred in March 2021. Both face charges of triple homicide, torture, coercion during the process and procedural fraud.


According to the IML report, the child suffered 23 injuries and died from internal bleeding caused by blunt action, discarding the initial version of a domestic accident presented by the defendants.


Civil Police investigations concluded that Henry was subjected to a routine of attacks and torture carried out by Dr. Jairinho.


Furthermore, according to the investigation, Monique Medeiros was aware of the violence. She would have been alerted by the boy's nanny at least a month before his death, but she consented to the situation.
