End of the 6×1 scale: Find out the rights proposed to workers

The PEC (Proposed Amendment to the Constitution) that foresees the end of the 6×1 scale can reduce the weekly working hours in Brazil to up to 40 hours and guarantee two days of rest per week, according to the opinion of the project's rapporteur, deputy Leo Prates (Republicanos-BA), presented this Monday (25).

The text establishes that the change, if approved in the Chamber and the Senate, must be implemented gradually. Firstly, the maximum working hours would fall to 42 hours per week within 60 days after the enactment of the PEC and, 12 months later, it would be reduced to 40 hours.

"The opinion recognized the need for gradual implementation of the measure, which is why a progressive scaling of the reduction in weekly working hours was proposed, allowing the adaptation of productive sectors and mitigating immediate economic impacts", states the document.

The proposal also determines that reducing working hours and increasing rest cannot result in salary cuts, including salary floors.

In practice, the model tends to replace the 6×1 scale with the 5×2 format, which guarantees two days of paid weekly rest, at least one of which is "preferably on Sundays".

The opinion also provides that conventions and collective agreements may adjust scales and compensatory regimes, as long as the working hours limit and the right to rest are respected.

The text maintains the possibility of flexible organization of working hours by sectors, such as commerce and essential services, including rules on compensation of hours, time banks and special working hours, such as the 12×36 scale.

According to Prates, the change seeks to increase workers' rest time and correct a distortion in the Brazilian working day.

The document highlights that the current scale can generate negative impacts on health, such as "cardiovascular diseases, depression and burnout syndrome", as well as greater risks of accidents and unscheduled absences in the workplace.

The opinion also argues that the new work organization can have positive effects on productivity, by reducing absences and turnover.

"Regular periods of rest, family life and the possibility of psychophysical recovery" are highlighted as direct benefits of the proposal.

Among the rights that remain reserved are:

- 13th salary;
- Holidays with an additional one third;
- FGTS (Service Time Guarantee Fund);
- Minimum salary set by law (currently at R$ 1,621);
- Maternity and paternity leave;
- Prior notice proportional to length of service, with a minimum of 30 days;
- Additional overtime (at least 50% of the regular hourly rate);
- Paid weekly rest;
- Additional remuneration for painful, unhealthy and dangerous activities;
- Insurance for occupational accidents, paid for by the employer.

The measure, however, still depends on approval in the Chamber of Deputies and the Federal Senate. After that, it will proceed to regulation in bills that must detail points such as compensation, specific scales and sectoral rules.
