Lawyer Matheus Menezes Matos, 25 years old, was once again considered unfit to take part in the competition for delegate of the Civil Police of Minas Gerais.


The preliminary results of the biophysical and biomedical exams were released by the public competition committee this week. According to the document, Matheus appears as "unfit sub judice PcD" after an evaluation carried out on April 26, 2026.


The case gained national repercussion after the minister of the STF (Supreme Federal Court), Alexandre de Moraes, previously overturned the candidate's elimination from the competition.

In the decision last March, Moraes determined that the organizing committee would offer reasonable accommodation in the TAF (Physical Aptitude Test) and carry out a new assessment for the candidate, who has dwarfism.


Matheus had been eliminated after failing to reach the minimum distance of 1.65 meters in the horizontal jump test. CNN Brasil asked the FGV (Fundação Getúlio Vargas), which made the results available, and the Civil Police of Minas Gerais, but did not receive a response until the publication of the report.

However, he failed the physical stage. The organizing committee, Fundação Getúlio Vargas, and the Civil Police of Minas Gerais argued that the notice did not provide for adaptations and that physical fitness would be essential for police activities.


The candidate's defense appealed to the STF alleging a violation of the understanding established by the Court in ADI 6,476.


According to this understanding, it is unconstitutional to exclude candidates with disabilities from reasonable accommodations in physical tests without objective proof that the requirement is essential for the exercise of the position.


Attacks on social media
After the repercussions of the case, Matheus' defense stated that he and his family began to suffer attacks and offensive comments on social media.


In a previously released note, lawyer Késia Oliveira stated that the demonstrations exceeded "the limits of respect and legality" and could constitute crimes against honor and discriminatory conduct. "Matheus and his family became targets of offensive comments, personal attacks and demonstrations that constitute, in theory, crimes against honor, in addition to possible discriminatory conduct."


Also according to the defense, the criminal demonstrations were recorded and must be subjected to appropriate legal measures. The objective would be to hold those responsible for the conduct accountable.


At the time of the first rejection, in March, the Civil Police of Minas Gerais, in partnership with FGV, stated that the competition provided for 54 vacancies for the position, with 10% of these vacancies destined for PCD candidates who had their physical condition proven in accordance with current legislation.


According to PCMG, the candidate in question signed up for the public competition for the career of Substitute Police Chief, Notice 01/2024, passing the objective, essay, oral and biomedical exams of knowledge. However, he failed the biophysical exams.


According to the police, the physical tests provided for in the notice are essential for the practical activities of the position of Police Investigator, as it often requires: "Chasing suspects; overcoming physical obstacles in difficult-to-access places and participating in police operations that require mobility, agility and physical resistance."


"Measuring the physical capacity of the candidate, named in the competition as Biophysical Exams, does not constitute an innovative criterion in the notice, since the aforementioned Organic Law of the PCMG provides that physical fitness is necessary for the qualification of a Police Officer", argues the institution.
