New video shows moment when diplomat's daughter is run over in Rio

A new video from a security camera, obtained by CNN Brasil, shows the moment when student Mariana Tanaka Abdul Hak, 20, is run over by a pickup truck in Ipanema, in the south zone of Rio de Janeiro.

The recording, about two minutes long, shows that the intersection was busy at the time of the accident, which occurred around 4pm on May 16th.

In the images, Mariana appears standing on the sidewalk next to her mother, diplomat Ana Patrícia Neves Abdul Hak, when the vehicle invades the pedestrian area and hits the victims.

The collision occurred at the intersection of Visconde de Pirajá and Vinícius de Moraes streets. The young woman succumbed to her injuries and died the next day. Her mother and another man injured in the accident survived.

Investigation remains ongoing
The Civil Police of Rio de Janeiro awaits the conclusion of expert reports to determine the causes of the accident.

The driver of the JAC T140 pickup truck, identified as Lucas, aged 21, stated in a statement that the steering wheel locked and the brakes failed before the vehicle climbed onto the sidewalk.

According to the police, the version will be compared with technical analyzes of the vehicle and security camera images.

Possible intent or culpable crime?
The legal framework of the case depends directly on the technical evidence.

Currently registered as a negligent bodily injury, the classification may change depending on the intensity of the risk potentially assumed by the driver.

Criminal lawyer Ana Krasovic points out that the line between negligence and intent is narrow.

"In conscious guilt, the agent foresees the possibility of an illicit result, but sincerely believes that he will be able to avoid it. In case of possible intent, the agent foresees the result and, even so, assumes the risk of producing it, demonstrating indifference regarding its occurrence", he explains.

The analysis of the location, which includes factors such as visibility and vehicle flow, will also make up the final report. For the expert, the distinction is vital, as it "defines whether the agent will be liable for a negligent or intentional crime", with significantly different penalties in the Penal Code.

The weight of mechanical and electronic expertise
The investigation, conducted by the 14th DP (Leblon), focuses on the alleged mechanical failure reported by the driver.

According to engineer and claims expert, Sergio Ejzenberg, analyzing the vehicle is essential to rule out hypotheses.

"Considering that it was an accident with minimal damage to the vehicle, the expert will be able to evaluate the steering and braking systems to verify their effective working condition", explains the specialist.

Another point of attention is the absence of braking marks on the asphalt, reported by the Military Police and witnesses.

If the examination does not identify defects in the car, the investigation must focus on the driver's behavior.

"If no faults are found in these systems, the cause of the accident will be something else to look for. In this case, possible driver distraction (use of cell phone) should be investigated", says Ejzenberg.

Mariana's family held a closed ceremony for the young woman's burial last Thursday (21) at the São Paulo Cemetery, in Pinheiros, in the west zone of the capital of São Paulo.

The young woman's father classified the loss as an "irreparable loss", highlighting that his daughter had returned to Brazil on the same day of the accident to start an internship at a multinational cosmetics company.

The driver cooperated with the investigations, showed no signs of change and, for now, is responding to the case in freedom.
