Former councilor Jairo Souza Santos Júnior, Dr. Jairinho, reversed his decision to dismiss his defense team this Monday morning (25), during the opening of the trial by the Jury Court in Rio de Janeiro.


The change of stance occurred after the Public Prosecutor's Office (MP) requested his transfer to the Bangu 1 maximum security prison, on the grounds that the defendant was using maneuvers to delay the process.

Attempted postponement and MP's reaction
At the beginning of the session, Jairinho claimed that it would be "impossible" to be judged due to the health condition of his main lawyer, Fabiano Lopes, who recently suffered a heart attack.


The defendant stated that he did not have enough time to align strategies with the other members of the panel and asked for the jury to be postponed.


In response, the prosecutor in the case classified the attitude as an attempt to "not want to face reality" and highlighted that the defense has been following the case for years.

Faced with the possibility of suspension, the MP asked that Jairinho be removed from Bangu 8, a unit intended for prisoners with higher education and a media profile, and sent to Bangu 1, a place of isolation for criminal leaders and highly dangerous inmates.

Evaluation of the judge and reconstitution of the panel


Judge Elizabeth Machado Louro, head of the II Jury Court, reinforced that society cannot be held "hostage" to procedural interruptions.


After a break from work and consultation with his lawyers, Jairinho decided to reconstitute part of his defense. Of the approximately 20 professionals who worked on the case, he chose to keep four names to continue the trial.


With the decision, the Sentencing Council, made up of five men and two women, was officially installed to analyze the accusations.

Accusations and context of the crime


Jairinho and his ex-wife, Monique Medeiros, are on trial for the death of Henry Borel, aged 4, which occurred in March 2021. Both face charges of triple homicide, torture, coercion during the process and procedural fraud.
