The mini-electoral reform that benefits political parties approved last week by the Chamber of Deputies now depends on analysis by the Senate. The proposal reaches the House to join others that also change electoral legislation and have been on hold since last year.


This is the case of the new Electoral Code and the PEC (Proposed Amendment to the Constitution) which ends the possibility of re-election, determines five-year terms, and unifies elections in Brazil.


The two matters were approved by the CCJ (Constitution and Justice Commission) and are awaiting a vote in the plenary. The texts were reported by Senator Marcelo Castro (MDB-PI), who has already expressed his intention to report on the mini-electoral reform approved by the deputies.

The request for the rapporteur was made to the president of the Senate, Davi Alcolumbre (União-AP). He stated that he had already been questioned by leaders about the prospects for analyzing the proposal.


"I will take note of the project, which has not yet reached the Senate and is still on the Chamber's table, to talk to the senators about the possibility of deliberation. In fact, Senator Marcelo Castro is one of the senators who wish to report, as well as others", Alcolumbre told journalists on Thursday (21).


Alcolumbre is responsible for defining the House's agenda. Since August 2025, the text of the new Electoral Code has been waiting to be discussed in the plenary. The PEC for the end of re-election, which has less support from parliamentarians, has been waiting even longer and has been blocked since May last year.

What the text says
The so-called mini electoral reform was approved by the Chamber on Tuesday (19). The project relaxes punishments for political parties by proposing the payment of fines in up to 15 years and limiting sanctions to acronyms.


The text allows the payment of fines applied to parties in up to 180 months, including those imposed before the project was approved. The PL also establishes a ceiling of R$30,000 for fines arising from disapproval of accounts. Furthermore, the trial of these cases may be terminated after three years, if not concluded within that period.


With an impact on the election year, the proposal also prohibits companies from suspending accounts without a court order, which could open up space and enable the mass shooting of messages using acronyms.


Another topic foreseen by the project is the limitation of charges made for acronyms resulting from party mergers. Parties that emerged from the merger of different groups cannot pay for previous sanctions or have assets or transfers from the Party Fund blocked.


The so-called amnesty for political parties is a recurring theme in Congress. The agenda usually has the support of the majority of parliamentarians, whether opposition or government.


The last approval of broad changes of this type occurred in August 2024. At the time, congressmen approved a proposal that dealt with the renegotiation of debts and forgiven acronyms for non-compliance with racial quotas by parties in elections. In the Senate, the text was reported by Marcelo Castro.


The amendment was promulgated by Congress, but was questioned by the STF (Supreme Federal Court). The trial at the Court was interrupted on Friday (22) after Minister Alexandre de Moraes requested a review (more time for analysis). The STF, however, has already formed a majority to validate the amendment approved by Congress.
