The Chamber of Deputies approved last Tuesday (19) PL (Bill) 2564/2025, which changes deforestation inspection practices in Brazil.


The project amends law number 9605 of 1998, guaranteeing producers the right to provide clarification on signs of illegal deforestation on rural properties before the application of punitive measures.


The text also prevents any embargoes from being based solely on detections made remotely, through sensing.

To come into force, the project must be approved by the Federal Senate and sanctioned by the President of the Republic.


According to the author of the PL, Lucio Mosquini (PL-RO), the change in the standard is to "correct injustices" and "guarantee legal security for the producer".


This approval comes weeks after the suspension of changes in the CMN National Monetary Council) that linked access to rural credit to environmental verification requirements from Prodes (Project for Monitoring Deforestation of the Brazilian Amazon Forest by Satellite).

This council measure was strongly criticized by agricultural entities, such as CNA (Brazilian Agriculture and Livestock Confederation) and FPA (Agricultural Parliamentary Front). The approval of the PL is seen as a response to the CMN's initial decision.


Impacts of change
For FGV (Fundação Getúlio Vargas) researcher, Leonardo Munhoz, the change comes to correct injustices generated by decisions based solely on satellite images.


"Remote sensing is just a photo, it doesn't tell the story of the property. The producer may be compensating for deforestation in other parts of the land, it's not possible to determine this through satellite alone", he stated.


He advocates that the process be carried out by crossing satellite images with national, state and municipal databases to ensure greater effectiveness.


Munhoz highlights that, currently, those who are notified via Prodes have difficulty accessing rural credit lines in time. For him, this change guarantees a "breathing" for the producer.


On the other hand, in the researcher's opinion, the changes planned in the process could increase the time and expense of operations, especially in cases where on-site inspection will be necessary to prove the assessment made via satellite.


For Munhoz, this PL is a response to ADPF (Argument of Non-Compliance with Fundamental Precept) 743.


Protocolated by the Rede Sustentabilidade and PSOL parties, the measure asks the STF (Federal Supreme Court) for the MMA (Ministry of the Environment) to have authorization to immediately suspend the CAR (Rural Environmental Registry) of properties in which illegal deforestation is identified based on the Prodes and Deter Não Floresta systems.

Repercussion
The FPA was one of the agricultural entities that celebrated the Chamber's decision: "a fundamental advance to guarantee legal security for rural producers". Speaking to CNN, the president of the front, Pedro Lupion (Republicanos-PR), stated that the project corrects distortions in the law.


"The agenda was among the bench's priorities in the recent mobilization held at the House and represents an important response to situations in which restrictions and sanctions can be applied without due analysis of the specific case", he highlighted.


"The project corrects distortions by preventing precautionary measures, embargoes or restrictions from being applied in advance and automatically, without the guarantee of contradictory and broad defense, principles guaranteed by the Constitution", he added.


On the other hand, the measure displeased environmental groups. WWF (World Wide Fund for Nation), an NGO (Non-Governmental Organization) defending environmental causes, criticized the approval.


"PL 2564/2025 creates obstacles to the application of environmental precautionary administrative measures and hinders fundamental inspection instruments, such as remote embargoes, which played a relevant role in reducing deforestation in the Amazon", stated the organization in a note.


For the Minister of the Environment, João Paulo Capobianco, this measure "deprives the use of a State tool to regulate rural credit".


Concern about deforestation


The FGV researcher assesses that this measure could increase the time in which the process is "open", which, in his view, "opens space for deforestation".


Lupion, however, argues that the measure does not weaken environmental inspection, it only corrects injustices for the producer and guarantees that punishments will only be applied with due data crossing.
