The Italian court denied extradition and authorized the release of former deputy Carla Zambelli (PL-SP). The trial took place on Friday (22), following a request from the defense, and Zambelli will now await another extradition request.


The former deputy was sentenced twice by the Federal Supreme Court (STF), once to 10 years in prison for invading the CNJ (National Council of Justice) system and another to 5 years and 3 months in detention for illegal possession of a weapon and illegal restraint.


The Supreme Court sent a single extradition request to Italy, but the Italian court decided to separate the cases.

In the lower court, the Court of Appeal in Rome gave two rulings in favor of extradition. This Friday, the Supreme Court of Cassation, the last instance of Italian justice, judged the case referring to the CNJ. There is still no date for analysis of the other process.


Zambelli's lawyer, Fabio Pagnozzi, however, stated in an interview with CNN that he believes the decision in the other case will be identical because this Friday the weapon possession case was also mentioned.


Zambelli has two processes; understand
The decision judged on Friday (22) refers to the conviction of the former deputy for invading the CNJ (National Council of Justice) system and issuing a false arrest warrant against minister Alexandre de Moraes, of the STF (Supreme Federal Court).

This same case had been tried in March this year, when the Italian court ordered Zambelli's extradition. The defense, however, appealed to the country's Court of Appeal, which corresponds to the second local instance.


The Court of Appeal, second Italian instance, judged both cases in the same hearing and The Court of Appeal judged both cases in the same hearing, but issued different decisions. For this reason, the appeals are now being analyzed separately by the Court of Cassation, the last instance of Italian justice.


Zambelli's second extradition process does not yet have a date for trial in the European country's last instance.


Lawyers and Zambelli celebrate decision
On social media, Zambelli's lawyer, Pieremilio Sammarco, published a video together with the former deputy, who declared that she was thrilled to be released. "Today, May 22, 2026, Saint Rita's Day, we did it. Pieremilio managed to do the impossible, which was to fight against a gigantic system," he said.


"And now we are free, thank God, to continue a life of mission. You don't know what this mission is yet, but you will soon know", said Zambelli.

According to the former parliamentarian's defense, "there is nothing more that Brazil can do". "They no longer have any other type of resource," said Fabio Pagnozzi in an interview with CNN Brasil.


The lawyer also stated that the former deputy is a victim of political persecution. "Carla is a persecuted politician, like many other politicians and non-politicians, but opponents of the government are in other countries, today, in the same situation as Carla Zambelli", he added.


Prison
Carla Zambelli was arrested on July 29 last year, after her name was included in the Interpol Red Diffusion as an international fugitive on June 5.


Zambelli, who has Italian citizenship, went to the European country in June last year after fleeing from Brazil to the United States the day after the STF (Supreme Federal Court) ruling and arrest order against her were issued.


After the change, the former parliamentarian was considered a fugitive from Brazilian justice. Before being arrested in Italy, the deputy recorded a video in which she said she was "very confident" in handing herself in, and that she would not return to Brazil to serve her sentence.


"Because here we still have justice and democracy. We don't have a dictator in power.

We do not have the dictatorial authority of Alexandre de Moraes and his Supreme Court cronies", he stated at the time.


Zambelli's convictions
Last year, the STF (Supreme Federal Court) sentenced Zambelli to five years and three months in prison after she was accused of chasing, with a gun in hand, a man in the middle of the street in an upscale neighborhood of São Paulo on the eve of the second round of the 2022 presidential election.


In May of the same year, the First Panel of the STF sentenced Zambelli to ten years in prison and hacker Walter Delgatti to eight years, both for the crimes of invading a computer device and misrepresentation.


In addition to the arrest, Zambelli also had her mandate as deputy revoked, but resigned from her position on December 14 last year, after the First Panel of the Court annulled a vote by the Chamber that kept her in the position.
