Mendonça votes to keep Vorcaro's cousin in prison; Gilmar asks for a view

Minister André Mendonça, of the STF (Supreme Federal Court), maintained this Friday (22) his decision to convert the temporary detention of Felipe Cançado Vorcaro, cousin of former banker Daniel Vorcaro, into preventive detention.

Now, the other ministers of the Second Panel need to assess whether they agree and maintain the decision. The case is being analyzed in a virtual session, a model in which judges have one week to register votes in the system.

When speaking about it, minister Gilmar Mendes asked for a review, that is, more time to analyze the case.

Felipe is identified by the PF (Federal Police) as one of the financial operators in the Master fraud scheme. He was the bank's controller and was arrested in early May, during the launch of the fifth phase of Operation Compliance Zero.

At first, the arrest was considered temporary, which means that it was carried out only to ensure the smoothness of the operation and that Felipe could be released after the warrants were served. Later, however, Mendonça decided to convert the prison to preventive, keeping Vorcaro's cousin incarcerated.

In the decision, the minister stated that there is evidence that the alleged illicit activities continued even after the investigations had progressed. Mendonça also cited the risk of criminal repetition, concealment of assets and interference in the investigation.

In addition to Mendonça and Gilmar, ministers Kassio Nunes Marques and Luiz Fux participate in the trial. Dias Toffoli, who is also part of the Second Panel, must declare himself a suspect and not participate in the vote, as he has done in all cases related to Banco Master.

Suspicion is a legal instrument in which judges refrain from participating in a trial due to doubts about their impartiality due to ties such as friendship with the parties, interest in the case, among others.

Vorcaro's cousin
According to the Federal Police, Felipe would be part of the "financial-operational core" of the investigated group, being responsible for carrying out suspicious financial and corporate transactions.

The investigation shows that he was directly involved in the sale of 30% of Green Investimentos to a company linked to the family of senator Ciro Nogueira (PP-PI). According to investigators, the equity stake, valued at around R$13 million, would have been negotiated for R$1 million.

In addition to the suspicious negotiation due to the undervaluation of shares, Felipe allegedly made monthly payments of R$300,000 in favor of the senator, later increased to R$500,000.
