The PEC special commission at the end of the 6×1 journey is holding the last seminar this Friday (22) in Manaus (AM) while awaiting the final adjustments for the presentation of the report by deputy Leo Prates (Republicanos-BA). The congressman will have the weekend to resolve a dispute between the government and opposition mainly surrounding the transition time.


The rapporteur must present the text next Monday (25). The deadline represents a delay in relation to the schedule established by the President of the Chamber, Hugo Motta (Republicanos-PB). The idea was for the text to be released last Wednesday (20) and then be voted on on May 26.


However, Prates announced that he would need more days to put together the final text, which meant that the expected plenary vote was postponed to May 28th. The delay could even impact the proceedings in the Senate. The president of Casa Alta, Davi Alcolumbre (União-AP), had said that he would take the PEC to the plenary in the first semester if the project was approved in the last week of May. The deadline is now tight.

Prates has already reinforced that he works with three pillars in the proposal: the reduction of working hours to 40 hours per week, the end of the 6×1 scale and the maintenance of salaries. The period for implementing the rule, however, is what has held up the congressman's report.


The government wants the end of 6×1 as soon as the text is approved in Congress with a minimum adaptation time, but is already talking about negotiating a transition of 2 to 3 years. The opposition talks about up to 10 years for the transition. Prates said he will look for a middle ground, but that "his wish" is for the two days off to take effect this year.


In recent weeks, the rapporteur has adopted the discourse that one of the focuses of his text will also be to strengthen the collective agreement and negotiations between trade unions and businesspeople. An example of this will be days off. According to the congressman, the text will define the basis that two days off are necessary, but each category can establish when these weekly days off will be.

Another focus would be to reduce pejotization and increase the number of workers registered with the CLT (Consolidation of Labor Laws). Prates even discussed the possibility of removing the limit on working hours for those who earn more than R$16,000 and are registered to encourage workers to register formally.


Another point still in dispute by businesspeople is the need for "compensation" for companies. They claim that reducing working hours will increase production costs and that this could impact small and medium-sized companies. One possibility presented through an amendment by opponents is a 50% reduction in the contribution to the FGTS.


To counter this argument, the government uses research from Ipea (Institute for Applied Economic Research). In a technical note released in February, the agency states that the impacts of the reduction would be similar to the impacts observed in historical readjustments of the minimum wage in Brazil, which would indicate a capacity for absorption of the measure by the labor market.


This division became clear this Thursday (21), during the commission's hearing at the Legislative Assembly of Santa Catarina. Businesspeople reinforced their position against the end of 6×1 and even asked for the possibility of maintaining a 44-hour week by convention. The leader of the PT in the Chamber, Pedro Uczai (SC), reinforced the position of ending the 6×1 scale immediately and that compensation "is not a possibility", since no advances for workers throughout history have been helped by businesspeople.


This Friday (22), the special commission will have the last seminar that will be held at the Legislative Assembly of the State of Amazonas. In addition to Prates, the president of the collegiate body will be present, as well as representatives of trade unions and businesspeople.


To monitor the vote, the government has called for union demonstrations in the federal capital to deliberate the text.

Minister Luiz Marinho's (Labor) idea is to "occupy Brasília" to press for the approval of a text that is beneficial to workers.


The commission analyzes two proposals that are being processed together, one from 2019, by deputy Reginaldo Lopes (PT-MG), and another presented last year by deputy Erika Hilton (PSOL-SP).


Both propose reducing working hours without losing wages for the worker. The Chamber's CCJ (Constitution and Justice Committee) approved the proposals on April 22, which paved the way for the issue to move forward in the House.


Now, in the special committee, deputies are analyzing the merits of the proposal, such as the possibility of a transition period. Some of the deputies also defend incentives for the productive sector to offset possible economic impacts of the measure.
